La utilización de la web www.eba-consulting.es (en adelante la “web”) por un tercero le atribuye la condición de usuario y supone la aceptación plena, por dicho usuario, de todas y cada una de las condiciones que se incorporan en la presente política de privacidad. En este sentido, se entenderá por usuario, la persona que acceda, navegue, utilice o participe en los servicios y actividades, gratuitas y onerosas, desarrolladas en esta web. La mera utilización de esta web por parte del usuario implica la adhesión de éste a las condiciones generales que Omar Julio España Arrieta, a través de su marca “EBA-Consulting Compartimos soluciones” (en adelante “EBA-Consulting”), tenga publicadas en cada momento en el que acceda a la web eba-consulting.es .
El responsable del tratamiento de datos y de su protección es Omar Julio España Arrieta, con nº de identificación 51189107-P y domicilio fiscal en c/ Gregorio Marañón, 5, Bloque 1, 1º – A, Boadilla del Monte, 28660, Madrid (en adelante el “responsable del tratamiento”).
La web otorga al usuario en todo momento los derechos sobre sus propios datos personales conforme a lo dispuesto en la Ley Orgánica 15/99 de Protección de Datos de Carácter Personal de 13 de diciembre y el Reglamento de Seguridad y en el Reglamento (UE) 2016/679 de 27 de abril de 2016.
2. Obtención de datos personales
Todos los datos personales que se recogen son aportados por el usuario, tras prestar consentimiento de manera explícita y para un fin o unos fines en concreto. En todos los casos, los datos personales se aportan voluntariamente por el usuario a través de un registro en la web o son aportados voluntariamente en las relaciones contractuales que puedan entablarse.
3. Datos de carácter personal que recogemos y fines
Solamente recopilamos información de identificación personal que es específica y que es proporcionada por el visitante a la página web. El responsable del tratamiento de datos sólo recibe información de identificación de nivel básico, en concreto, alguno o algunos de los siguientes datos personales: Nombre completo del titular de la información; dirección de correo electrónico; teléfono; nombre de la empresa a la que pertenece; o curriculum vitae. Se trata de la información mínima necesaria para completar la solicitud de un visitante o para formalizar un contrato de prestación de servicios. La información de identificación se recoge para los siguientes fines:

● La mínima necesaria para la formalización de un contrato de prestación de servicios, en el ámbito de la formación, consultoría o asesoría.
● Admisión, reserva de plaza y matriculación en cursos formativos.
● Realización de cursos o actividades gratuitas (MOOC’s, tests).
● Participación en el Blog.
● Suscripción a la newsletter.
● Presentación de currículum para postularse como colaborador.
● Información publicitaria acerca de actividades formativas, de consultoría o asesoría a través del sitio web o por correo electrónico.
4. Destinatarios a los que se comunicarán sus datos personales
Exclusivamente podrán tener acceso a sus datos personales nuestros prestadores de servicios, ubicados dentro y fuera del Espacio Económico Europeo (EEE). Los destinatarios ubicados fuera del EEE se encuentran acogidos al “Privacy Shield” (EE.UU.). Sin perjuicio de lo anterior, los datos personales no se comparten con otras entidades en la red para fines secundarios o no relacionados, ni se comparten con terceros, salvo que se encuentren amparados por una base legal.
5. Plazos de conservación de los datos
Los datos se conservarán durante la vigencia del contrato y, posteriormente, siempre que el interesado no haya ejercitado su derecho de supresión, serán conservados teniendo en cuenta los plazos legales que resulten de aplicación a cada caso concreto, la tipología de los datos y la finalidad del tratamiento.
6. Protección de datos y medidas de seguridad
El responsable del tratamiento de datos ha adoptado los niveles de seguridad y protección de los datos personales y ha instalado todos los medios y medidas técnicas a disposición según el estado de la tecnología para evitar la pérdida, mal uso, alteración, acceso no autorizado y robo de los datos personales facilitados.
Esta web además cuenta con un Certificado SSL, que es el acrónimo de Secure Sockets Layer (capa de sockets seguros), que es la tecnología estándar para mantener segura una conexión a Internet, así como para proteger cualquier información confidencial que se envía entre dos sistemas. Esta tecnología utiliza algoritmos de cifrado para codificar los datos que se transmiten e impedir que los hackers los lean al enviarlos a través de la conexión. Esta información podría ser cualquier dato confidencial o personal. Se puede verificar la veracidad del certificado haciendo click en el candado de color verde al inicio de la url de cada página.
Utilizamos una técnica de seudonimización, mediante cifrado con clave secreta (encriptación). Asimismo, se cuenta con un sistema de seguridad web para análisis de problemas avanzados, para la eliminación de malware y para la reparación de hackeo. Y todo ello con un tiempo de respuesta de 12 horas.
Una vez al año se procede a la evaluación y valoración de la eficacia de las medidas técnicas y organizativas que garantizan la seguridad del tratamiento.
Hay varios lugares en la web que pueden vincular a otros sitios web que no operan bajo la Política de Privacidad de eba-consulting.es . Cuando usted se conecta a otros sitios webs, las prácticas de privacidad de EBA-Consulting ya no se aplican. Animamos a los visitantes a revisar la política de privacidad de cada sitio antes de divulgar cualquier información de identificación personal.
Asimismo, a través de la web se pueden realizar compras y, en concreto, a pagos a través de PayPal con el fin de hacer más fácil para los visitantes comprar productos en línea. Los visitantes pueden buscar productos en la lista de compras de la página web y, a continuación, hacer clic en un enlace para conectarse al sitio de PayPal con el fin de hacer una compra. 7. Derechos en relación al tratamiento que hacemos de sus datos

Asimismo, también en determinadas circunstancias, podrá oponerse al tratamiento de sus datos personales. En ese caso, se cesará en el tratamiento de los datos personales, salvo que concurran motivos legítimos, o para garantizar el ejercicio o la defensa de posibles reclamaciones.
Por último, podrá solicitar el derecho a la portabilidad y obtener para sí mismo o para otro prestador de servicios determinada información derivada de la relación contractual.
Para el ejercicio de los derechos mencionados, deberá dirigirse por escrito a la dirección de correo electrónico privacy@eba-consulting.es, concretando el derecho que desee ejercitar y debiendo acreditar la identidad de la persona que ejerce sus derechos, mediante el envío de copia de su DNI, NIE, Pasaporte o documento equivalente, por las dos caras.
La información solicitada se le facilitará en el plazo de 15 días, pudiendo prorrogarse por 15 días más en caso necesario, atendiendo a la complejidad y al número de solicitudes.
Podrá retirar el consentimiento en cualquier momento, en el caso de que se haya otorgado el consentimiento para alguna finalidad específica, sin que ello afecte a la licitud del tratamiento basado en el consentimiento previo a su retirada.
Podrá presentar reclamación ante la Autoridad de Control competente en materia de protección de datos. No obstante, en primera instancia, podrá presentar reclamación ante el responsable del tratamiento de datos, quien resolverá la reclamación en el plazo de 1 mes.
